Parts of 2021 election law tossed

Glenda C Wolin | Published on 8/19/2023

A federal judge has ruled that portions of the 2021 Texas omnibus voting law violate the federal Civil Rights act. The bill’s provisions, which added the voter’s driver’s license or partial Social Security number on the mail ballot application and the ballot envelope, ordered elections officials to reject either one if the number was missing or incorrect.

San Antonio-based Judge Xavier Rodriguez said rejections based on errors unrelated to qualifications for voting violate the 1964 federal Civil Rights Act’s Materiality Provision.

Almost 22% of mail ballots were rejected in Bexar County during the 2022 primary elections, up from 2-3% before the law took effect.
